'The Lyric Legend Contest' Official Rules
NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. OPEN TO PARTICIPANTS 18 YEARS AND OVER. VOID WHERE PROHIBITED.
1. SPONSORING ORGANIZATION. 'The Lyric Legend Contest' (the “Contest") is sponsored by Flocabulary, Inc. ("Flocabulary") with an address of 55 Washington Street, Suite 606, Brooklyn, NY 11201.
2. ELIGIBILITY. The contest is open to persons 18 years of age and older who are current Flocabulary subscribers. Eligible contestants may submit on behalf of individual students or a group of students. Eligible contestants must be Flocabulary subscribers. Flocabulary reserves the right to confirm compliance with eligibility requirements. Entries generated by script, macro, other automated means, or by any method that interferes with the legitimate fair play of the Contest are void. Flocabulary expressly reserves the right to disqualify and delete any entries that it believes in good faith are in violation of these Official Rules for any reason. Entries that are determined, in the sole discretion of Flocabulary to constitute advertisements, commercial messages, or “spam” will be disqualified and deleted. If disqualified, Flocabulary reserves the right to terminate the entrant’s eligibility to further participate in this Contest and future promotions and contests of Flocabulary or any of its subsidiaries or affiliates.
3. HOW TO ENTER. The Contest will begin at 12:00 a.m. Eastern Time on Tuesday, February 9, 2016. Entries must be received by 12:00 p.m. Eastern Time on March 5, 2016. To enter, go to the contest page, and follow directions to enter. You may submit multiple entries. There is no fee to submit an entry. By submitting an entry to the Contest, each entrant agrees to comply with these Official Rules.
WINNER SELECTION. The Contest judge(s) shall be the employees of Flocabulary or such person(s) selected by Flocabulary (the "Judge"). The Judge will select two (2) Contest Winners at his or her sole discretion and based on the following selection criteria: creativity, topical relevance and educational relevance, with each category having equal weight. The Judge may conduct a run-off if there is a tie, to select the two (2) Contest Winners from amongst equally high-scoring entries based on overall quality in the Judge’s discretion. All of the Judge’s decisions are final. The Contest Winner will be notified via email. Each Contest Winner will receive a prize pack for use of their students in the classroom, consisting of a microphone and stand, headphones, and an iPad. Each Contest Winner will have the opportunity to work with Flocabulary to have their winning lyrics included in a Flocabulary video. Flocabulary will require that the Contest Winner signs a written consent, and also obtains a written consent from every student author of the winning lyrics with a signed parental acknowledgment in a form satisfactory to Flocabulary in its discretion, for purposes of rights clearance. If the Contest Winner is unable to obtain the written clearance materials from every author, the Contest Winner and his or her students will keep the prize pack, but will not be eligible to have the lyrics included in a Flocabulary video, and Flocabulary may (but is not obligated to) select another runner-up entry to feature as a Contest Winner pursuant to these Official Rules. A list of winners and/or a copy of these official rules may be obtained up to 90 days after the close of this Contest by email request to info [at] flocabulary.com, or by letter to Flocabulary, 55 Washington Street, Suite 606, Brooklyn, NY 11201 (with self-addressed, stamped envelope included for return response).
GENERAL TERMS AND CONDITIONS. By entering the Contest, each entrant grants permission to Flocabulary to use the name of his/her school in a Flocabulary video about the Contest, and for any and all other promotional purposes without compensation. The contest may require submission of text, photos, videos or other media (the "Media"). Entrants grant to Flocabulary the right to publish, exhibit and distribute the Media in any and all formats. Entrants warrant that Media are original works and that submission is not a violation of rights to privacy, copyright or any other nature. If the Media contains images or video of minors and/or students, entrant represents and warrants that he/she has secured the consent of the depicted individuals' legal guardian for the publication and distribution of image and videos depicting the individual online and in any and all formats. Each entrant represents and warrants that he/she meets the eligibility requirements. Entrant agrees to defend and indemnify Flocabulary for any and all claims and liabilities related to above warranties. Flocabulary reserves the right to terminate, modify or suspend this Contest at any time. Flocabulary is not responsible for lost, late, illegible or incomplete entries, or for technical or human errors or failures of any kind in connection with the submission, transmission, processing or judging of entries. This Contest shall be governed by New York law. By participating in this Contest, entrants agree that New York courts shall have jurisdiction over any dispute or litigation arising from or relating to this Contest and that venue shall be only in the New York State and Federal courts located in New York County, New York. The failure to exercise or enforce any right or provision of these Official Rules shall not constitute a waiver of such right or provision. If any part of these Official Rules is held by a court of competent jurisdiction to be invalid or unenforceable, that part will be enforced to the maximum extent permitted by law, and the remainder of these Official Rules will remain fully in force. By entering the Contest, you will be agreeing that any information collected in connection with the Contest may be used by Flocabulary in accordance with Flocabulary’s Privacy Policy, a current copy of which can be found at http://flocabulary.com/privacy-policy/.
